O DISCURSO DO ÓDIO NAS REDES SOCIAIS: OS RISCOS E VANTAGENS DA SOCIEDADE INFORMACIONAL E O TRATAMENTO JURÍDICO BRASILEIRO – O RACISMO VELADO

Resumo

Tendo-se em vista o crescente uso das redes sociais de relacionamento e a velocidade com que as informações se propagam no espaço virtual a divulgação de conteúdos intolerantes, ofensivos e preconceituosos nesse meio é exponencialmente mais nocivo à sociedade, e é desta necessidade em combater o discurso de ódio nas redes sociais que o Direito deve adaptar-se. O presente trabalho busca analisar este fenômeno onde a sociedade globalizada atua de forma horizontal, como o sistema judiciário brasileiro julga litígios envolvendo casos de discurso de ódio e porque o racismo ainda encontra-se incrustado de forma velada em nossa sociedade. Para cumprir este objetivo utilizou-se dos métodos bibliográficos, documental e análise de casos. Apesar da liberdade de expressão que o meio virtual possibilita, os direitos humanos sempre servirão como barreira limitando conteúdos com manifestações de ódio.

HATE SPEECH IN SOCIAL NETWORKS: THE RISKS AND ADVANTAGES OF INFORMATIONAL SOCIETY AND BRAZILIAN LEGAL TREATMENT - VEILED RACISM

Abstract: Having in view the increasing use of the relationship of social networks and the speed with which information propagates in the virtual space dissemination of intolerant, offensive and biased content that environment is exponentially more harmful to society, and it is this need to fight hate speech on social media that the law must adapt. This study aims to analyze this phenomenon where the global society operates horizontally, as the Brazilian judicial system judges litigation cases of hate speech and because racism still is embedded in a veiled way in our society. To meet this goal we used bibliographic methods, documentation and analysis of cases. Despite the freedom of expression that allows virtual environment, human rights will always serve as a barrier limiting content with expressions of hatred.
