O PREÇO DO AFETO: A (IR)RESPONSABILIDADE PELO ABANDONO AFETIVO NAS RELAÇÕES DE PARENTALIDADE

Resumo

A temática deste trabalho abarca o Direito de Família e o Abandono Afetivo, focando-se na responsabilidade familiar nas questões que englobam a afetividade. A relevância desta matéria, dá-se a partir do estudo dos aspectos históricos e contemporâneos das relações familiares e da atual configuração da família, bem como na proteção integral e no sistema de tutela de direitos da criança e do adolescente. Para tanto, busca-se identificar se a ausência de afeto pode ser a mola propulsora de indenização no que se refere à responsabilidade pelo abandono afetivo nas relações de parentalidade. Quanto à metodologia, esta se trata de pesquisa bibliográfica, que tem por objetivo buscar o posicionamento da legislação, da doutrina e de decisões jurisprudenciais a respeito da responsabilidade civil pelo abandono afetivo. Nesse ínterim, a própria Constituição Federal se posiciona a respeito da relevância dos laços familiares, afirmando que, quanto ao direito à convivência familiar, a criança e o adolescente devem ter prioridade absoluta. Por fim, destaca-se que, independentemente do modelo de família, deve-se colocar o papel essencial da família em destaque, o afeto e o carinho, pois estes são fundamentais para o desenvolvimento psíquico e emocional saudável dos filhos.

THE PRICE OF AFFECTION: THE (IR)RESPONSIBILITY FOR AFFECTIVE ABANDONMENT IN PARENTING RELATIONSHIP

Abstract: The theme of this work includes the Family Law and the Affective Abandonment, focusing on family responsibility in issues that involve affectivity. The relevance of this matter takes place from the study of historical and contemporary aspects of family relations and current family settings, as well as full protection and child rights protection system and adolescents. Therefore, we sought to identify whether the lack of affection can be the mainspring of compensation in respect of the responsibility for emotional abandonment in the parenting relationships. So, considering the contemporary setting of family entities, compensation is presented as a solution to mitigate the effects arising from family conflicts emerging from the lack of family life. As for the methodology, it comes to bibliographic research, which aims to get the positioning of legislation, doctrine and jurisprudence regarding the civil responsibility for the emotional abandonment. Meanwhile, the Federal Constitution itself is positioned regarding the relevance of family bonds, stating that, for the right to family life, children and adolescents should have absolute priority. At last, it is emphasized that, regardless of the family model, it should put the key role of prominent family, affection and care, as they are fundamental to the psychological and emotional development of healthy children.
