A PRESTAÇÃO DE CONTAS NA PERSPECTIVA DA OBRIGAÇÃO ALIMENTAR DOS FILHOS MENORES

Resumo

O presente estudo tem por objetivo analisar o cabimento da ação de prestação de contas em ações de alimentos, isto é, averiguar se há possibilidade de o genitor que não possui a guarda do filho menor exigir a prestação de contas por parte de quem administra a verba alimentar. Embora a jurisprudência até então tenha sido contrária a este direito, busca-se uma reflexão acerca da importância dessa fiscalização, não para exclusão do dever de alimentar, mas como proteção do principal interesse da criança e do adolescente. A real finalidade de exigir a prestação de contas, nesse caso, é apurar se existe ou não a má gestão dos bens por parte de quem administra a pensão, pois se este valor não for devidamente usado poderá o incapaz sofrer prejuízos e ser privado de suas necessidades básicas.

 ACCOUNTABILITY FROM THE PERSPECTIVE OF MAINTENANCE OBLIGATION OF CHILDREN

Abstract: This study aims to examine the appropriateness of the action of accountability in maintenance obligation, that is, determine whether there is a possibility of the parent who does not have custody of the child require accountability on the part of those who manage maintenance obligation. Although the case law so far has been opposition to this right, we seek to reflect on the importance of that review, not excluding the duty to feed, but as protection of the main interests of the child and adolescent. The real purpose of requiring accountability in this case is to determine whether there is mismanagement of the estate by who manages the board because if this value is not properly used can the powerless suffer losses and be deprived of their basic needs.
