ESTATUTO DA CRIANÇA E DO ADOLESCENTE: IMPLEMENTAÇÃO DOS TRÊS SISTEMAS DE GARANTIAS DECORRENTES DA DOUTRINA DA PROTEÇÃO INTEGRAL E CONCESSÓES À DOUTRINA DA SITUAÇÃO IRREGULAR

Resumo

Os Direitos da criança e do adolescente estabelecidos pela Constituição Federal de 1988 foram regulamentados pelo Estatuto da Criança e do Adolescente, Lei nº 8.069/90, a qual é tida por muitos como uma das legislações mais avançadas na área. Contudo, apresenta problemas relacionados à garantia de direitos. Nesse contexto, o presente artigo pretende tecer considerações sobre o contexto atual e dificuldades de implementação dos três sistemas de garantias previstos na lei 8.069/90 decorrentes da doutrina da proteção integral. Além disso, almeja analisar possíveis concessões à antiga doutrina da situação irregular nos dispositivos do Estatuto e na conduta de seus destinatários relacionando-as com as dificuldades na implementação dos três sistemas de garantias.

STATUTE OF CHILDREN AND ADOLESCENTS: IMPLEMENTATION OF THE THREE SYSTEMS OF GUARANTEES ARISING FROM THE DOCTRINE OF INTEGRAL PROTECTION AND CONCESSIONS TO THE DOCTRINE OF THE IRREGULAR SITUATION

Abstract: The Rights of the Child and teenager established by the Federal Constitution of 1988 were regulated by the Statute of Children and Adolescents, Law 8.069/90, which is regarded by many as one of the most advanced legislation in the area, but that presents problems related to implementation rights on which it has, especially with regard to the application of educational measures. In this context, this article aims to elaborate about the current context and difficulties of implementation of the three systems of guarantees provided for in Law 8.069 / 90 resulting from the doctrine of integral protection. In addition, it seeks to examine possible concessions to the old doctrine of irregular situation in the provisions of the Statute and in the conduct of its addressees relating them to difficulties in implementing the three guarantee systems.
