INVESTIGAÇÃO CRIMINAL DIRIGIDA PELO MINISTÉRIO PÚBLICO

Resumo

O presente trabalho tem por objetivo analisar a legalidade da investigação criminal dirigida, autonomamente, pelo Ministério Público. Para tanto, será exposto, como é realizada a persecução criminal no Brasil, em que consiste e qual a finalidade de sua primeira fase que é a da investigação criminal, bem como, do que se trata e qual órgão competente para realizar o inquérito policial, peça fundamental da investigação criminal. Examinar as normas constitucionais e infraconstitucionais a respeito das funções do Ministério Público e da Polícia Judiciária, assim como, os direito e garantias fundamentais que devem ser respeitados em toda persecução criminal. O tema se mostra de grande relevância, visto o interesse de toda a sociedade na resposta rápida e efetiva do Estado. Respeitado os entendimentos contrários, este trabalho procura demonstrar a ilegalidade de uma investigação criminal realizada, diretamente, pelo Ministério Público, amparados por lei e com a ideia de que devemos sempre buscar um Estado Democrático de Direito onde seja assegurado a todo e qualquer cidadão o devido processo legal. Busca-se, dessa forma, expor os motivos que levam a defender que a investigação criminal seja de competência exclusiva da Polícia Judiciária e somente supervisionada pelo Ministério Público.

CRIMINAL INVESTIGATION ADDRESSED BY THE PUBLIC MINISTRY

Abstract: This work has for objective to analyze the legality of criminal investigation directed independently by prosecutors. To do so, will be exposed, as is the criminal persecution in Brazil, what is and what is the purpose of its first phase of criminal investigation, as well as, what it is and what organ competent to carry out the investigation officer, cornerstone of criminal investigation. Examine the constitutional requirements and the compliance with the infra-constitutional functions of the Prosecutor and the judicial police, as well as the rights and fundamental guarantees that must be respected in all criminal persecution. The topic is of great importance, given the interest of the whole society on quick response and effective State, however, cool and respectful to constitutional guarantees conquered over the years. Respected the contrary understandings, this work seeks to demonstrate the illegality of a criminal investigation conducted, directly, the public prosecutor, themparados by law and with the idea that we should always seek a democratic State of law where it is secured to any citizen due process, search, thus exposing the reasons that lead to defend that the criminal investigation is of exclusive competence of the judicial police and only supervised by prosecutors.
