A JUSTIÇA TRANSICIONAL E O NOVO CONSTITUCIONALISMO LATINO-AMERICANO: DO ROMPIMENTO COM O PASSADO AOS DESAFIOS DA TRANSFORMAÇÃO

Resumo

O presente estudo tem como objetivo analisar a Justiça de Transicional, entendendo seu funcionamento como instrumento de transição de um regime democrático para outro, esclarecendo durante a pesquisa quais são seus conceitos e delineamentos, com especial destaque aos eixos de reparação ou dimensões os quais são alicerçados sobre alguns fundamentos básicos consagrados pela literatura: verdade, memória, justiça, reparação e reforma das instituições. Contemplar a evolução do direito constitucional cominando com o surgimento do novo constitucionalismo latino americano, analisando o seu significado, funcionamento e existência. Grande destaque para a importância dos direitos humanos dentro do processo de evolução da sociedade, sua internacionalização e a consolidação de suas garantias, presente tanto nas políticas públicas de transição, quanto no ambiente de transformação do novo constitucionalismo latino americano. Com a finalidade de compreender de que forma o novo modelo constitucional latino americano, relaciona-se com a justiça de transição, já que é particular a ambos, grandes transformações na estrutura política e das instituições com especial atenção a participação social.

A TRANSITIONAL JUSTICE AND THE NEW LATIN AMERICAN CONSTITUTIONALISM : THE BREAKING WITH THE PAST CHALLENGES OF TRANSFORMATION

Abstract: This study aims to analyze the Justice of Transitional understanding its functioning as a transitional instrument of a democratic regime to another, clarifying when searching what their concepts and designs with special emphasis on repair axes or dimensions which are grounded on some basic fundamentals enshrined in literature: truth, memory, justice, reparation and reform of the institutions. Contemplate the evolution of constitutional law cominando with the emergence of new constitutionalism Latin American, analyzing their meaning, operation and existence. Great emphasis on the importance of human rights within the process of evolution of society, its internationalization and consolidation of its guarantees, present both in public policy transition, and in the new Latin American constitutionalism processing environment. In order to understand how the new Latin American constitutional model relates to transitional justice, as it is particular to both major changes in the political structure and institutions with special attention to social participation.
