A VALORIZAÇÃO DA PESSOA HUMANA NAS RELAÇÕES FAMILIARES: A IMPORTÂNCIA DO AFETO E A RESPONSABILIDADE CIVIL POR ABANDONO AFETIVO

Resumo

O presente trabalho tem o objetivo de trazer uma compreensão contemporânea da família, reconhecendo-se a importância da realização pessoal e afetiva dos indivíduos que a integram, bem como examinar a possibilidade da propositura de ações indenizatórias por abandono afetivo do(s) filho(s). Ressalte-se que a aplicação das normas constitucionais às relações interprivadas tem sido realizada, atualmente, pela doutrina e pela jurisprudência, no que se refere a inúmeros institutos de Direito Civil, principalmente a família. No âmbito familiar, há um contínuo movimento do Direito aos reclamos de uma sociedade que se transforma e abriga as mais variadas formas de convivência familiar e de laços de afeto. Nesse sentido, vislumbra-se a necessidade de comprometimento dos pais no desempenho do poder familiar em relação aos filhos menores, sob pena de responsabilidade civil.

VALUATION OF THE HUMAN PERSON IN FAMILY RELATIONSHIPS: THE IMPORTANCE OF AFFECTION AND LIABILITY FOR AFFECTIVE ABANDONMENT

Abstract: This paper aims to approach a contemporary understanding of the family, recognizing the importance of personal and affective development of individuals who belong to it, as well as examining the possibility of bringing damage claims for affective abandonment of children. It is noteworthy that the application of constitutional laws to interprivate relations has been held currently by doctrine and jurisprudence, with respect to numerous institutes of civil law, especially the family. When it comes to family, there is a continuous movement of the Law to the demands of a society that keeps changing and hosts the most varied forms of family living and ties of affection. In this sense, one can glimpse the need for involvement of parents in the performance of family custody regarding younger children, under penalty of liability.
