O PRINCÍPIO DA DIGNIDADE DA PESSOA HUMANA PARA O CIDADÃO-PRESO

Resumo

Este trabalho tem o objetivo de abordar a questão dos direitos fundamentais, especificamente no tratamento dispensado ao cidadão-preso, com enfoque no Princípio da Dignidade da Pessoa Humana, apresentando as falhas e o descaso com as garantias legais pertinente a todo indivíduo. A metodologia utilizada foi de cunho bibliográfico, tendo como principais norteadores Alexandre Moraes, Flávia Piovesan, Clóvis Gorczevsk, Ingo Wolfgang Sarlet e Rogério Grecco. Considerando que a pesquisa inicia-se a partir dos Princípios Constitucionais e Fundamentais, no referencial teórico abordou-se o conceito e a evolução histórica dos direitos humanos bem como o Princípio da Dignidade da Pessoa Humana. Nas considerações finais destaca-se que a solução para esse caos possa ser alcançada a longo prazo com a construção de novos presídios e penitenciárias capazes de uma correta aplicação da individualização da pena, e também no comprometimento da sociedade em exigir que o Estado promova políticas públicas em proteção desses indivíduos, pois eles estão sofrendo com seus direitos inaplicados.

The Principle Of Human Dignity For The Citizen-Arrested

Abstract: This paper aims to address the issue of fundamental rights, specifically in the treatment of the citizen prisoner, focusing on the Principle of Human Dignity, showing the flaws and the neglect of legal safeguards relevant to every individual. The methodology used was bibliographic nature, the main guiding Alexandre Moraes, Flavia Piovesan, Clovis Gorczevsk, Ingo Wolfgang Sarlet and Roger Grecco. Whereas the search begins from the Constitutional and Fundamental Principles, the theoretical framework discussed the concept and the historical evolution of human rights and the Principle of Human Dignity. The conclusion shows that the solution to this chaos in the long term can be achieved with the construction of new prisons and penitentiaries capable of a correct application of the individualization of punishment, and also the commitment of society to demand that the State promotes public policies protection of these individuals, as they are suffering from their inaplicados rights.
