A CONSTITUIÇÃO DO ESTADO CIVIL COMO ARTIFÍCIO BASEADO NO CONSENTIMENTO E NO JUSNATURALISMO EM THOMAS HOBBES

Resumo

Este artigo objetiva apresentar a constituição do Estado Civil como um artifício da humanidade, embasada no consentimento e no jusnaturalismo, para livrá-la da exacerbada fúria de posse que toma conta do desejo humano quando em estado natural. Todos os homens são iguais e têm direito a tudo e, seguindo seus desejos, agarram-se à força e à astúcia desencadeando a guerra de todos contra todos. A única maneira de refrear esta guerra é, tendo como subsídio o consentimento e o jusnaturalismo, realizar o pacto social entre eles, quando todos abdicam seu direito natural e condicionam sua liberdade, cujo ato dá origem ao Estado Civil. Neste espaço político é possível viver efetivas liberdades, controlando a competição por meio do mecanismo de todas as vontades e de todas as razões em apenas uma, o homem artificial - Leviatã.

THE CONSTITUTION OF CIVIL STATUS AS A DEVICE BASED ON CONSENT AND JUSNATURALISM IN THOMAS HOBBES

Abstract: This article presents the constitution of the Civil Status of humanity as a device, based on consent and natural law, to free her from the fury of aggravated possession that takes account of human desire when in its natural state. All men are equal and are entitled to everything and followed their desires, they cling to the strength and cunning triggering the war of all against all. The only way to curb this war is taking as input the consent and natural law, carry out the social compact between them, when they relinquish all their natural right and condition your freedom, an act which gives rise to the Civil State. In this space you can live effective political freedoms, controlling the competition through the mechanism of all desires and all reasons in just one, the artificial man - Leviathan.
